Tag: The Rehabilitation Act

The Rehabilitation Act of 1973 is a landmark civil rights law that prohibits discrimination on the basis of disability in programs conducted by federal agencies, programs receiving federal financial assistance, federal employment, and in the employment practices of federal contractors.

Key Provisions:

  • Section 504: This section is particularly relevant to education. It prohibits discrimination against individuals with disabilities in any program or activity receiving federal financial assistance, including schools. This means schools must provide reasonable accommodations to students with disabilities to ensure they have equal access to education.
  • Section 501: This section prohibits federal agencies from discriminating against qualified individuals with disabilities in employment.
  • Section 503: This section requires federal contractors and subcontractors to take affirmative action to employ and advance in employment qualified individuals with disabilities.

Impact on Special Education:

Section 504 has a significant impact on special education by:

  • Expanding Eligibility: Section 504 protects a broader range of students than IDEA, including those with disabilities that don’t necessarily require specialized instruction but may need accommodations to access education.
  • Providing Accommodations: Schools must provide reasonable accommodations to students with disabilities who qualify under Section 504, such as modified assignments, assistive technology, and accessible facilities.
  • Ensuring Equal Access: Section 504 ensures that students with disabilities have equal access to educational opportunities and extracurricular activities.

Understanding the Rehabilitation Act and its provisions is crucial for advocating for the rights of individuals with disabilities and ensuring they have equal access to education and employment opportunities.
